Introducción
La privacidad de las personas, incluidos nuestros clientes, es de suma importancia para PayJoy Panamá Inc. (la “Compañía”). Estamos comprometidos en cumplir con las normas aplicables que rigen la Privacidad de las personas a quienes ofrecemos nuestros productos y servicios.
De conformidad con los principios de justicia y transparencia, así como al derecho del interesado a ser informado, esta Política de Privacidad de PayJoy (la “Política”) le proporciona a usted, el interesado, la información sobre el tratamiento de su información personal (la “Información”) de una manera clara, adecuada, transparente y de fácil acceso.
Esta Política tiene como objetivo establecer en términos claros los tipos de información recopilada, el motivo de dicha recopilación, la fuente de la Información, las entidades con las que dicha Información puede ser compartida, los derechos del interesado, así como las prácticas y procesos adoptados por la Compañía para el adecuado manejo de dicha Información.
Por favor lea detenidamente esta Política, a medida que usted continúe navegando en el sitio web, utilice o compre cualquiera de los productos o servicios que nosotros ofrecemos (“los Servicios”), o si proporciona cualquier Información a la Compañía por el uso mismo de nuestro sitio web o por cualquier Servicio, asumimos que dicha Información la está proporcionado de manera voluntaria, así como todo lo que se estipula en la presente Política se basa en dicho supuesto.
Tipo de Información Recopilada
A fin de prestarle los Servicios, la Compañía puede recopilar y procesar la Información de acuerdo a las siguientes categorías:
Información acerca de Usted
De manera enunciativa, más no limitativa,
(i) Datos Personales: nombre, número de identificación oficial, correo electrónico, número telefónico, su fotografía.
(ii) Reporte de Información Crediticia, Listas Negras, y Servicios de Validación: copias solicitadas de su historial crediticio que contengan su información tanto profesional como financiera. Verificamos su información en listas públicas como las de la “OFAC”. Utilizamos los Servicios de Validación para asegurar la veracidad y calidad de los Datos Personales que recibimos.
(iii) Información en Redes Sociales: información proporcionada en sus redes sociales incluyendo su foto, lista de amigos y nombre.
(iv) Copia de Documentos: documentación recopilada incluyendo el número de identificación oficial.
(v) Información de Pago: información relacionada al cómo cumplir sus obligaciones con PayJoy.
(vi) Servicio al Cliente: la información que nos proporcione en relación con los Servicios, incluso cuando se comunique con nosotros, por cualquier medio, con fines de servicio al Cliente.
En todo caso, la recolección y tratamiento de la Información se hará con consentimiento previo ya sea por escrito o en forma electrónica por su propietario.
Información Sobre su Dispositivo Móvil
De manera enunciativa, pero no limitativa, información relacionada al dispositivo, el sistema operativo, el identificador del dispositivo, información de la SIM, IMEI, la lista de aplicaciones, el estado de conexión a internet, el estado de la aplicación en primer plano, etc.
Si el dispositivo es comprado, alquilado o arrendado a través de PayJoy, la Compañía recabará información relacionada con esa transacción, como la tienda donde ocurrió la misma, el importe de la transacción, etc.
Información Sobre su Comunicación
Si usted proporciona la autorización específica, la Compañía podrá recopilar y procesar la información de su dispositivo móvil relacionada, pero no limitada, a registros de llamadas y mensajes SMS. Antes de hacerlo, nos pondremos en contacto con usted y le solicitaremos su consentimiento expreso.
Cookies
Una cookie es un pequeño archivo de texto que un servidor web coloca en su computadora o dispositivo cuando su navegador accede a un sitio web. Las cookies almacenan información específica de un cliente o sitio web y están diseñadas para crear un registro o «recordar» la actividad en línea. Finalidad de la Recopilación
La Compañía podrá o deberá recopilar, utilizar, recibir, poseer, procesar, almacenar, tratar, revelar, transferir o manejar la Información para los siguientes fines:
- Cuando usted contrata los Servicios de PayJoy, la Compañía requiere procesar su Información para autenticar su identidad y evaluar el riesgo de cumplimiento a la contraprestación.
- Procesamos y almacenamos parte de su Información para la prevención del fraude con el fin de garantizar una mayor seguridad a PayJoy, a usted y al sistema financiero en general.
- También necesitamos su información para ponernos en contacto con usted por cualquier medio disponible, incluidos los medios electrónicos, correo o teléfono (SMS y otros), sobre asuntos relacionados con los Servicios durante el proceso de contratación o incorporación a los Servicios y posteriormente durante la prestación de los mismos. Esto incluye la notificación de cambios en la Plataforma y/o en los Servicios. También podemos contactarlo para ofrecerle o proporcionarle información sobre productos o servicios que puedan ser de su interés.
- Del mismo modo, tratamos su Información para gestionar sus obligaciones de contraprestación y fines de cobro.
- Podemos procesar su Información para el análisis de datos, investigación y estadísticas, para evaluar y estudiar el perfil de los usuarios de nuestros Servicios, con fines de mercadotecnia y publicidad, re-ofrecimiento de Servicios (retargeting) y para desarrollar mejores productos, ofertas y servicios.
En caso de que se requiera dar un uso distinto a los datos previamente obtenidos, la Compañía obtendrá el consentimiento por parte de su propietario.
Decisiones automatizadas
La toma de decisiones automatizada se produce cuando un sistema electrónico procesa datos personales para tomar una decisión sin intervención humana. Parte de nuestros procedimientos, especialmente la evaluación de su capacidad de cumplimiento a obligaciones de contraprestación, depende de mecanismos de decisión automatizada y, por lo tanto, garantizamos su derecho a solicitar la revisión de cualquier decisión tomada basada exclusivamente en el tratamiento automatizado de sus datos, de acuerdo con la Ley.

Cuando usted visita nuestros sitios web, podemos recopilar información de usted automáticamente a través de cookies o tecnologías similares.
Intercambio de Información
La Compañía puede compartir información sobre usted con:
- Agencias gubernamentales, tribunales o autoridades supervisoras, según lo requiera la legislación aplicable;

La Compañía no proporciona ninguna declaración ni garantía sobre la forma en la que las entidades receptoras puedan utilizar o divulgar su Información.
Transferencias internacionales
La Compañía podrá transferir la información personal que recopilamos sobre usted a destinatarios en países distintos del que se recopiló originalmente la información. Cuando la Compañía se haya basado en su consentimiento para procesar determinada información y usted haya dado el mismo para procesar dicha información, usted tiene derecho a retirar dicho consentimiento en cualquier momento.
Derecho a Presentar una Reclamación
Tiene derecho a presentar una reclamación ante la autoridad de protección de datos competente.
Cómo Ejercer sus Derechos
Cualquier solicitud para ejercer sus derechos puede dirigirse al responsable de la protección de datos de PayJoy. La identidad y los datos de contacto del responsable de la protección de datos se encuentran al final de la presente Política.
Antes de procesar su solicitud, la compañía deberá verificar su identidad. La solicitud debe:
- Proporcionar información suficiente que nos permita verificar razonablemente que usted es la persona sobre la que recopilamos información personal, o un representante legal de dicha persona
- Describir su solicitud con detalles suficientes que nos permita entender, evaluar y responder adecuadamente a la misma.

Privacidad de los menores de edad
Nuestros servicios no están dirigidos a individuos menores de dieciocho años, por lo que la Compañía no recopila información personal de menores de dieciocho años.
Medidas de Seguridad
La Compañía ha implementado prácticas y procedimientos de seguridad razonables que se ajustan a las normas aceptadas internacionalmente para la seguridad y protección de la información. - (iv) Copies of Documents: collected documentation. including government IDs
- (v) Payment Information: information about how you pay your obligation with PayJoy
- (vi) Customer Service: information you provide to us in connection with the Services, including when you communicate with us, by any means, for Customer service purposes.
Information Concerning Your Mobile Device
Including but not limited to information regarding the device, operating system, device identifier, SIM information, applications list, internet connection state, application foreground state, etc.
If the device is purchased, rented or leased via PayJoy then we collect information relating to that transaction such as store where transaction occurred, amount of transaction, etc.
Information Concerning Your Communication
If you provide specific authorization, we may collect and process information from your mobile device related but not limited to call logs and SMS messages. Before doing so we will contact you and request your specific consent.
Cookies

Purpose of Collection

- When you contract PayJoy Services, we need to process your Information to authenticate your identity and assess risk of repayment.
- We process and store some of your Information for fraud prevention to ensure greater security to PayJoy, to you and to the financial system in general.
- We also need your Information to contact you by any available means, including electronic means, mail or telephone (SMS and others), on matters related to the Services during your onboarding to our Services and later on throughout the services provision. This includes notifying you of changes in the Platform and/or in the Services. We may also contact you to offer or provide information on products or services that may be of your interest.
- We also process your Information to manage your payment obligations for payment collection purposes.
- We may process your Information for data analytics, research and statistics, for assessing and studying the profile of our Service’s users, and for developing better products, offers and services.
- And in connection with other business of the Company from time to time.
Automated Decisions
Automated decision-making occurs when an electronic system processes personal data in order to make a decision without human intervention. Part of our procedures, especially the assessment of your ability to pay obligations, relies on automated decision mechanisms and, so, we guarantee your right to request the reviewing of any decision made exclusively based on automated processing of your data, according to the law.

The Company collects Information directly from you, your use of the Services, as well as from any third parties whom you may have authorised to share such Information with the Company.

Mobile device
The Company collects Information from your mobile device via the PayJoy mobile application installed on your mobile phone. You may check what information is being collected by PayJoy’s app in the privacy section of your mobile device.

When you visit our websites, we may collect information from you automatically through cookies or similar technology.
Sharing
The Company may share Information about you with:
- Governmental agencies, courts or regulators, as required under applicable law;
- Any agent, contractor, service provider or other third party in connection with the Company’s business and in connection with the provision of the Services; and
- Any other person under duty of confidentiality to the Company.
If the Company is involved in merger, acquisition, financial due diligence, corporate reorganization, bankruptcy proceedings, sale of assets or transition of outsourced services to another provider, your Information may be sold or transferred as part of such a transaction as permitted by applicable law. We will need to verify your identity before processing your request. The request must:

- Describe your request with sufficient detail that allows us to properly understand, evaluate and respond to it
We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm the personal information relates to you.
We do not charge a fee to process your request. We will respond to your request within reasonable time, as defined by the relevant law.
Children’s Privacy
Our services are not directed to children under the age of sixteen and we do not knowingly collect personal information from children under the age of sixteen.
Security Measures
The Company has implemented reasonable security practices and procedures that are in line with internationally accepted standards for the security and protection of Information. These practices and procedures include managerial, technical, operational and physical security control measures commensurate with the nature of Information collected and processed by the Company.
Updates
